These Terms of Service ("Terms") govern your use of https://hauseassociates.com and the communications services offered by Hause Associates LLC dba Hause Associates Real Estate Services ("Hause Associates," "we," "us," or "our"), including our SMS text messaging program. By using this website, submitting a form, or opting in to receive text messages from us, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the site or our messaging program.

2. Use of This Website

You may use this website for lawful, personal, non-commercial purposes related to buying, selling, or learning about real estate. You agree not to scrape, harvest, republish, or redistribute listing data; attempt to gain unauthorized access to any part of the site; interfere with its operation; or use it to transmit unlawful, harassing, or misleading content. You must be at least 18 years old to submit information through this site.

3. Property Listings and IDX Data

Listing information displayed on this site is provided through the Internet Data Exchange (IDX) program of the Pikes Peak Association of REALTORS® and is supplied by participating brokerages. It is provided for consumers' personal, non-commercial use and may not be used for any purpose other than identifying properties consumers may be interested in purchasing. Listing data is deemed reliable but is not guaranteed accurate, and properties may be subject to prior sale, change, or withdrawal without notice. Square footage, lot size, taxes, schools, HOA information, and similar details should be independently verified.

4. No Professional Advice; No Agency Relationship

Content on this site is general information, not legal, tax, financial, appraisal, or investment advice. Home valuation estimates are automated or informal opinions, not appraisals. Submitting a form, receiving a text message, or otherwise communicating with us does not by itself create a brokerage, agency, or fiduciary relationship. A brokerage relationship is created only by a written agreement signed by you and Hause Associates as required by Colorado law.

5. SMS Text Messaging Terms and Conditions

These messaging terms apply to text messages sent by or on behalf of Hause Associates Real Estate Services.

Program description

Hause Associates Real Estate Services operates an SMS program that sends real estate communications to consumers who have opted in. Messages may include:

• Conversational and lead follow-up messages — replies and follow-up to inquiries you submitted about a property, a home valuation, or our services
• Transactional messages — showing and appointment confirmations and reminders, document requests, and transaction or closing updates
• Customer care messages — responses to questions and service requests you send us
• Marketing and promotional messages — new listings, open houses, price changes, market updates, and occasional newsletters

How you opt in

You are enrolled only after giving express written consent. You may do this by checking the SMS consent box on a form on hauseassociates.com, by providing your mobile number and agreeing in writing or verbally during a conversation with one of our agents, or by texting us first. The consent language on our web forms reads:

I consent to receive SMS notifications, alerts, and occasional marketing from Hause Associates Real Estate Services. Message frequency varies. Msg & data rates may apply. Text HELP to (719) 900-5222 for help or STOP to unsubscribe anytime.

Consent to receive text messages is not a condition of purchasing any property, product, or service from us. You must be at least 18 years old and the subscriber or authorized user of the mobile number you provide. If you change or give up that number, you agree to notify us so we do not message its new holder.

Message frequency

Message frequency varies based on your activity and the stage of your transaction. Conversational and transactional messages are sent as needed; marketing messages are typically sent no more than a few times per month.

Cost

Message and data rates may apply. Hause Associates does not charge for the messages themselves, but your mobile carrier may charge you for messages sent or received according to your plan. Contact your carrier for details about your plan.

How to opt out

You can cancel at any time by replying STOP to any message from us. After you send STOP, we will send one confirmation message and will send no further messages unless you opt in again. You may also text UNSUBSCRIBE, END, CANCEL, QUIT, or REVOKE, or contact us at (719) 900-5222 or lloyd@hauseassociates.com. To rejoin, opt in again through a form or by texting us.

How to get help

Reply HELP to any message from us for help, or contact us at (719) 900-5222 or lloyd@hauseassociates.com. We will respond with our identity and contact information and with instructions for opting out.

Carriers and delivery

Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your wireless carrier and is not guaranteed. Supported carriers may change over time and are not liable for the content of messages.

Privacy of your mobile information

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third parties. See our Privacy Policy for full details on how we collect, use, and protect your information.

6. Email Communications

If you provide your email address, you may receive listing alerts, market updates, and other communications from us. You can unsubscribe at any time using the link in any marketing email or by contacting us directly.

7. Intellectual Property

The design, text, graphics, logos, and other content of this site, other than third-party listing data and licensed photography, are owned by Hause Associates LLC dba Hause Associates Real Estate Services or its licensors and are protected by copyright and trademark law. You may not copy, reproduce, or create derivative works from them without our written permission.

8. Third-Party Services and Links

This site embeds and links to third-party services, including MLS/IDX property search and our lead-capture and messaging platforms. We do not control and are not responsible for their content, availability, or practices. Your use of those services is governed by their own terms and privacy policies.

9. Fair Housing

To the fullest extent permitted by law, Hause Associates LLC dba Hause Associates Real Estate Services and its owners, agents, and employees will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits or lost opportunities, arising out of your use of this website or our messaging program, even if advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless Hause Associates LLC dba Hause Associates Real Estate Services and its owners, agents, and employees from any claim, loss, or expense, including reasonable attorney fees, arising from your misuse of this site or your violation of these Terms or applicable law.

13. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of this site will be brought exclusively in the state or federal courts located in El Paso County, Colorado, and you consent to their jurisdiction.

14. Changes to These Terms

We may revise these Terms at any time. The effective date above shows when they were last updated. Your continued use of the site or our messaging program after a change constitutes acceptance of the revised Terms.
